生态损害的司法救济是我长期关注的议题，但本书的写作还存在着更直接的动因。2011 年渤海湾发生了生态损害后果特别巨大的“康菲溢油案”，但案件的处理过程，肇事方态度的敷衍与傲慢，行政监管的迟缓与乏力，涉案渔民养殖户进行环境侵权诉讼的艰难，公益诉讼的无疾而终，刑事追责的缺失以及生态损害国家索赔所带来的种种迷雾，一度深深地刺激了我。可以说，该案集中暴露了生态损害行政矫正的功能限度与生态损害司法救济所遭遇的尴尬。因此，笔者重拾此案，作为剖析生态损害法律救济中存在的问题并导入本书研究主题之切入点。
